Terms of use

1. Who we are and what these terms cover

Gorilla Gainz consists of the app for iOS and Android and the website gorillagainz.app. The provider and your contract partner is Cloo GmbH, Reumtengrüner Str. 32B, 08209 Auerbach, Germany, registered in the commercial register of the Amtsgericht Chemnitz under HRB 38181, represented by the managing directors Yannick Seeger and Paul Otto (the "we" below). You find all details about the provider in the Impressum (legal notice).

These terms apply to the use of the app and the website. Two more documents belong to them:

• the community rules, which apply to everything you post, write or start, and
• the privacy policy, which explains which data we process.

2. What Gorilla Gainz is

Gorilla Gainz is an app for calisthenics. You can build, start and log workouts, keep a daily streak, have a profile, post, find friends and groups, plan sessions, train together live, take part in challenges and find and add spots (places to train). With the camera, the app can count repetitions.

Using Gorilla Gainz is free. There is also a paid subscription, Premium (section 9). We keep developing Gorilla Gainz, and features can change (section 11).

3. Your account

You sign in with Apple, Google or a code that we send you by e-mail. There are no passwords. You are responsible for making sure that only you have access to your sign-in methods. In the app you can end suspicious sign-ins in the list of signed-in devices.

Your details must be correct: an e-mail address that belongs to you and your real date of birth. A nickname is enough as a name. Your name and username must not mislead, for example by posing as the Gorilla Gainz team or as another person. You cannot change your date of birth in the app; we correct obvious typos on request at support@gorillagainz.app.

Create only accounts that you use yourself. Fake accounts and accounts that get around a suspension or the age check are not allowed.

You can delete your account at any time: in the app under Profile › Settings › Account › Delete account, or on the website under Delete account. Your account is hidden at once and permanently deleted after 14 days. During that time you can keep it by signing in again. What happens to your data when you delete is explained in the privacy policy. Deleting does not end a Premium subscription (section 9).

4. Minimum age

Gorilla Gainz is for people aged 14 and older. When you first sign in, we ask for your date of birth. If you are younger than 14, you cannot use Gorilla Gainz and your account is deleted at once. If we find out later that someone is younger than 14, we suspend the account and delete it unless there is an appeal within 14 days.

Accounts of people under 18 start private. There are no features that need consent for 14 and 15 year olds: verified sets with video for challenges and the AI reading for notes are available from 16. If you are under 18, you use Gorilla Gainz with the consent of your parents or guardians, where the law requires it.

Purchases by minors follow the family and parental controls of Apple and Google. We do not offer a payment method of our own.

5. Your content

Your content stays yours. Content is everything you put into Gorilla Gainz: posts with photos and videos, comments, profile, workouts and templates, ratings, descriptions, groups, sessions. You keep all rights to it.

The right you give us. So that we can show your content, you grant us a simple, non-exclusive right to store it, process it technically (for example resize it, check it, create thumbnails and preview cards for shared links) and show it and make it available in the app and on the website as your visibility settings provide. The right is not limited by territory because the website can be reached from anywhere. It lasts as long as the content is with us and ends when you delete the content or your account. Excluded are backup copies (up to 7 days) and records that we keep under the community rules or for legal reasons, for example about reports. If you share a workout template and someone imports it, that person may keep and use their copy.

What you promise us. You have the rights to what you post and the necessary consent of the people shown in it. You do not post content that breaks laws, the rights of others or the community rules.

You decide who sees your content. Posts go to the audience you choose. If your account is public and you are at least 18, your profile can also be seen on the website without signing in, and anyone with the link can read posts with the audience "Everyone" there. Such posts are not listed by any search engine or in any list. Accounts under 18 have no website page. Public sessions show time and place to everyone.

What we cannot take back. We cannot take back what others have already seen, shared or copied, such as screenshots.

Our content. The app, its design, the exercise library and the Gorilla Gainz brand belong to us or our licensors. You get the simple, non-transferable right to use the app privately.

6. Spots and spot data

Spots come first from OpenStreetMap and from what people like you add. All details about the name, location and equipment of a spot form a database that we publish regularly (see Data sources).

If you create a spot or change details of a spot, you confirm that you did not copy them from Google or any other closed source. The name, location and equipment of a spot are public and are licensed under the Open Database License (ODbL). Photos, ratings and descriptions are yours; you allow us to show them in the app and on the website.

Do not add private places (home, garden) as spots.

7. How you may use Gorilla Gainz

The community rules apply. In addition:

• You obey the law.
• You do not get around filters, limits, suspensions, the age check or the check of the camera counter. You do not fake workouts, personal bests or challenge results.
• You do not set up automated accounts and you do not read out the app and website automatically on a large scale. You do not disturb operation and you do not access data or accounts of others.
• You report only what you really believe is a violation. Mass reports without grounds are a violation themselves.
• If you arrange to train with someone through Gorilla Gainz, you meet in a public place and tell someone where you are.

8. What we do about violations

There is no tolerance for objectionable content or abusive users on Gorilla Gainz. We do not check content in advance, except with the automatic checks described in the community rules. That is why reports matter. If someone breaks these terms or the community rules, we can hide or remove content, issue warnings, restrict posting and commenting for a time or suspend the account. The community rules say which steps exist and when each one applies. For serious violations we suspend at once and report them to the authorities where required.

For every decision we give you the reasons, including whether automatic means took part. A person decides whether content is removed or an account is suspended. You can appeal every decision (see the community rules).

We accept reports of illegal content in the app through "Report", and on the website and without the app by e-mail to support@gorillagainz.app. This address is also our single point of contact for users and authorities under Regulation (EU) 2022/2065 (Digital Services Act).

9. Premium

What Premium includes. With Premium you can log workouts as a note (with an optional AI reading for unclear lines, from 16 and only with your consent), log by voice (on devices with speech recognition on the device) and use deeper statistics. Everything else stays free, including community, live sessions, challenges, streak, camera counting and the export of your data.

Prices and term. At launch, Premium costs €3.99 per month or €29.99 per year in the euro area. The store shows you the exact price in your currency before you buy. With the yearly plan there is a free trial of 7 days for eligible users; after that, the paid subscription begins. The subscription renews automatically for the chosen term until you cancel it.

Purchase and cancellation through the store. You subscribe through the Apple App Store or Google Play. The store collects the payment and manages the subscription. You cancel in the store (app: Profile › Settings › Premium › "Manage subscription") and you must do so in good time before the end of the current term. You also switch between the monthly and yearly plan there.

After you cancel. Premium stays active until the end of the paid term. After that, the Premium features are locked. Your data stays, and so do the free features.

Deleting your account does not end a subscription. Cancel in the store first, before you delete your account. Otherwise the payments continue.

Refunds. Refunds go through Apple or Google. If the store refunds you, your Premium ends at once.

Price changes. If the price changes, the store informs you under its own rules. You can then cancel.

AI reading. The AI reading is voluntary and available only from 16. It applies only to lines that the app cannot read itself, and only if you agreed to it. You can withdraw your consent at any time (Settings › Privacy). The app's note recognition also works without it. To keep cost and misuse in check, the AI reading is limited per person (currently 10 per hour, 40 per day and 400 per month).

Family Sharing. Premium cannot be shared through Family Sharing.

10. Train at your own risk

Gorilla Gainz is no substitute for medical advice. Train only when you are healthy, and listen to your body. Ask a doctor if you are unsure. You decide what you do. This also applies to workouts and challenges with others and to meetings that you arrange through Gorilla Gainz: we do not organize them.

The camera counter is an aid and can be wrong. We can correct challenge results after a review.

11. Availability and changes to the service

We do our best to run Gorilla Gainz reliably, but we cannot promise that it is always available without interruption. Maintenance, outages at providers or force majeure can limit the service for a time. Many features also work offline and sync once you are connected again.

We may change, replace or discontinue features if this is reasonable for you. For the paid term of Premium we keep the promised Premium features, unless we cannot for reasons beyond our control.

12. Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee.

For slight negligence we are liable only if we breach an essential contractual duty. Essential duties are those whose fulfilment makes the contract possible in the first place and on which you can regularly rely. In that case, liability is limited to the damage that is typical for this kind of contract and foreseeable. Any further liability is excluded. This also applies to our employees and agents.

We are not responsible for content of users as long as we do not know of illegal content. As soon as we learn of it, we act.

13. Suspension and termination

You can end your use of Gorilla Gainz at any time by deleting your account (section 3).

We can suspend or delete your account under the community rules. For serious or repeated violations this can happen at once. If we want to discontinue the service or individual features, we give reasonable notice. A Premium subscription ends under the rules of the store.

14. Changes to these terms

We can change these terms if there is a good reason, for example new laws, new features or gaps in the text, and if it is reasonable for you. For material changes we show you the notice "We updated our terms of use." in the app, with "View" and "Agree". You can keep using Gorilla Gainz once you agree. If you do not agree, you can delete your account. Changes that only fix typos or clarify the text, we make without this notice. You see the date of the current version at the top of this page.

15. Governing law and place of jurisdiction

German law applies. If you are a consumer and you usually live in another country, the mandatory consumer protection rules of that country remain unaffected. For businesses, legal entities under public law and special funds under public law, the place of jurisdiction is the seat of Cloo GmbH, as far as the law allows.

16. Final provisions

The German version of these terms is binding. The English version is a translation. If a provision is invalid, the others remain valid, and the statutory rule replaces the invalid one.
